Foothills Soft Wash
Customer Terms and Conditions

This Customer Contract (the “Contract”), by and between Foothills Soft Wash (“Company”) and Client, is effective when Client accepts Company’s proposal or estimate. It explains the terms for residential and commercial exterior cleaning services, including pressure washing, soft washing, roof cleaning, window cleaning, deck cleaning, and gutter cleaning.

1. Acceptance of Terms
By accepting an estimate, Client agrees to all terms in this Contract and authorizes Company to perform the services listed in the estimate. Client agrees to hold Company harmless for property damage not caused by Company’s negligence. Company is not responsible for damage noted before work, including damage to siding, paint, wood, trim, windows, oxidation, landscaping, or roofing.

2. Binding Agreement
This Contract is the entire agreement between the parties. Changes are binding only when made in writing and signed by the parties.

3. Authorizations
Client will provide Company, its employees, and representatives access to the property for assessment, service, and follow-up. Client will provide an accessible outdoor water source. Well-water or low-pressure conditions must be disclosed in advance; extra water-supply fees may apply. Company equipment does not connect to the home’s electrical supply. Company is not responsible for pre-existing or unrelated spigot damage. Services cannot proceed during active construction or home-improvement work; a $150 cancellation fee may apply if Company arrives and cannot work. Emergency or weather-related services will be rescheduled for the next available business day.

4. Payment Terms
Payment is due upon completion unless otherwise agreed in writing. Cash, check, and credit are accepted. Invoices or scheduled payments more than 10 days past due are subject to a 7% late fee. For net-30 accounts, payment is due within the stated grace period; a 7% late fee may apply after 30 days past due. Company may pursue collection and may decline future work for repeated late payment.

5. Risks and Releases of Liability
Company takes reasonable precautions, but damage can result from poor maintenance, neglect, low-grade materials, or existing conditions. Pre-existing damage may be documented by checklist and photographs. Service may stop if new damage is discovered until Client acknowledges it. Company uses procedures to protect plants, but is not responsible for pre-existing leaf burn, wilt, or landscape damage.

6. House Wash Acknowledgment
Client must provide a suitable water source or arrange paid water delivery. Existing oxidation, flaws, and blemishes may become more visible after cleaning. Client should shut off exterior electrical outlets and fixtures. Site-unseen estimates cannot identify every surface defect. Cleaning solutions, weep-hole runoff, basic window cleaning, water spots, screen removal, and window haze are subject to the conditions described in the original contract. Company is not liable for worn or brittle screens.

7. Roof Treatment Acknowledgment
Client must provide a suitable water source or arrange paid water delivery. Roof-treatment results vary based on roof material, age, location, and buildup. Company does not use force to remove growth when doing so could cause damage or affect a manufacturer warranty. Natural granular loss and previously covered damage may become more visible after cleaning.

8. Roof Touch-Ups
Light brown areas or remaining dead algae may appear after treatment and can take 6–8 weeks or longer to fade with rain and sun. Client may contact Company afterward so the parties can assess whether reapplication is needed. Necessary touch-ups are not charged when part of the original treatment.

9. Client Obligations on the Service Date
Doors and windows must be closed. Remove pet waste, sensitive items, outdoor furniture, vehicles, and window screens where appropriate. Keep pets and children indoors. Do not use other water outlets. Provide a working water source with steady pressure of approximately 40 PSI, or make alternate arrangements with Company.

10. Exclusions and Limitations
A 20%–30% non-refundable deposit may be required to reserve service and is applied to the final invoice. A $55 water-source fee, $150 cancellation or construction fee, $100 non-negligence review fee, $100 screen-removal fee, and $45 returned-check fee may apply as described in the contract. Company is not responsible for water intrusion caused by inadequate seals, undisclosed sensitive surfaces, unreachable areas, unreachable nests, stripping services, oxidation removal, storm windows or leakage, faulty or uncovered outlets, furniture removal, runoff, weep-hole residue, vines, artillery fungus, paint splatters, tree sap, wood stripping, open windows, well-water problems, window spotting from house washing, paint runs or fading, electrical-cover failures, or fogging from failed multi-pane seals. Company does not guarantee 100% stain removal and will not use pressure when damage could result.

11. Content Use and Release
Client permits Company to use photos, videos, reviews, or property descriptions for advertising without compensation, while excluding personal or sensitive information. With approval, Company may display a marketing sign for up to seven days. Client may be charged for damaged signage.

12. Company’s Damages Liability
Company is responsible for damage directly caused by its negligence, operator error, or willful misconduct. Damage must be reported within two days after service. Client must allow Company 30 calendar days after notice to inspect and address the issue before taking further action.

13. Severability
If a provision is found invalid, the remaining provisions remain in effect.

14. Attorneys’ Fees and Costs
If either party breaches this Contract, the non-breaching party may recover reasonable attorneys’ fees and costs related to notice, demands, and enforcement.

15. No Waiver of Breach
Failure to enforce a provision is not a waiver of that provision or any other available remedy.

16. Choice of Law
This Contract is governed by South Carolina law, without regard to conflict-of-law rules.

17. Amendments
All amendments must be in writing and executed by all parties.

18. Forum Selection, Jurisdiction, and Venue
The parties submit to the jurisdiction of federal and state courts located in Greenville County, South Carolina, and waive objections to jurisdiction or venue there.

19. Electronic Communications Consent
By providing contact information or submitting a form, Client agrees to receive emails and text messages from Foothills Soft Wash about quotes, scheduling, service updates, marketing offers, and review requests. Message and data rates may apply. Reply “STOP” to opt out.
